How to Copyright Your Music

I get asked about how to copyright music a lot too. You'd be surprised at the number of artist who really don't know how to go about copyrighting their music. This article is for you. Even if you know the process don't count this info out, read it anyway, Im sure you might learn somthing you did not know. I  hope you find this info helpful either way. Your works should ALWAYS be copywritten before you inteoduce your new music to the public, people steal and you don't want to get got....feel me? Soooooo, below you will find a very informative article with links and everything. Let it be your guide.

How Do I Copyright My Music?
That's a question I get asked a lot. And so, I decided I might as well write a formal article about it.

I discuss the issue in detail in my book,
How to Promote Your Music Successfully on the Internet, so I've more or less included an excerpt from that here. So here we go...
Why Copyright My Music?
If you see yourself as a serious musician (and I presume you do), you would be wise to register your original songs with the U.S. Copyright Office (if you reside outside of the U.S., skip to the section on International Copyright below). This will protect you in the event that someone, somewhere, steals one of your songs and claims it as their own. Whether you want to copyright just one song for possible digital distribution or an entire CD of collected works, the process is the same.
The eCO Online System
The U.S. Copyright Office encourages you to register your music via an online registration process called the eCO Online System. Once you go there, create an account for yourself, then log in and you’re ready to start. Registering a copyright via this process is not all that difficult, but the technical language can be confusing. The online process does walk you step-by-step through filling out the document, but even so, take your time. Carefully read the help links (the underlined text) provided each step of the way. If you do that, it will help you understand what information goes where.

You’ll find a
copyright tutorial for the eCO system at http://www.copyright.gov/eco/eco-tutorial.pdf . I recommend you take a look at that before you undertake this process to see what you’re in for.
The filing fee for online song registration is $35.

A few tips regarding the eCO process that I think might help you:

  • You’ll want to register your music as a "sound recording" as this kind of registration includes not only the performance, but the underlying music itself.
  • Under "Title of Work" add the name of your CD first and set the "Type" as "Title of work being registered." Then list your song titles and set the "Type" for those as "Contents Title." So the album name is the "Title," the individual songs are the "Contents."
  • If you have cover songs on your album, you’ll exclude those under the "Limitation of Claim" section. For example, if track 7 on your CD is a cover tune, under "Material Excluded" check the boxes for "Music" and "Lyrics" (if you have lyrics) and then in the space for "Other" indicate "Track 7." Then under "New Material Included" check all the boxes and under "Other" list the track numbers for your original songs. So here you specify what tracks to exclude for copyright registration (because they belong to someone else) and which tracks to register under your own name. If all the songs on your album are original, you can skip this section entirely.

Once you have filled out the form and verified all your information, add it toyour cart, pay for it, and then you’ll receive an email with instructions on how to print out your registration and mail it in with copies of your CD. You can also upload the files digitally, if you prefer.

If you don’t wish to go through the online process, you can type all of your information in Form CO, print it out and mail it in.
And you’ll find instructions for Form CO at http://www.copyright.gov/forms/formco2d-ins.pdf . Fill out the PDF file following the instructions and then print TWO copies. One copy for yourself, and one copy to mail to the Library of Congress to the address provided.

The cost to submit the form by mail is $50.00.
Either way you go, whether online or via mail, it will take six months to a year for the Library of Congress to process your registration. However, once you’ve submitted your work, you’re officially protected. If you use FedEx to send your copyright forms (which I suggest you do), keep your tracking number handy and you can present this as legal proof of your effective date of copyright registration should you ever need it.
What Does Copyright Registration Do for Me?
Well, if someone does steal your work, not only can you prove the work is yours by your registration, but you can also sue for damages (you can’t legally sue for damages if your song isn’t registered with the copyright office). If the copyright infringement is determined to be deliberate, your attorney can initiate a formal criminal investigation.

Registering your songs' copyright grants you these exclusive rights:


  • The right to make copies and duplicate your CD
  • The right to distribute your music
  • The right to prepare derivative works (alternate versions, new arrangements)
  • The right to perform the songs publicly
  • The right to display the product publicly
  • The right to perform publicly via digital audio transmission

Once you’ve registered your sound recording (your CD) with the U.S. copyright office, these rights belong exclusively to you and you alone (provided, of course, that you are the actual copyright owner). No one can take those rights from you.

Once your song is registered, you no longer have to worry about someone stealing your song idea and taking credit for it. If someone does that, gets a hit out of it and you can prove the song is yours with your registered copyright, you are going to smile all the way to the bank when the court awards you damages, which can be very high for copyright theft.
How to Copyright Individual Digital Creations
What if you only want to copyright a single song (or video, or photo, or article, or blog or whatever) to prove it’s yours? See
http://www.myfreecopyright.com/ . At this web site you can upload your digital files, be they music, video, pictures or whatever, and they are instantly copyrighted and you can prove the date/time of registration. The service is free, and it’s a very simple way to copyright your individual music creations. Just so you know, however, even though you can use this digital copyright in a court of law to prove infringement, you cannot collect statutory damages from the infringer. You can collect lost profits that might be determined, but not statutory damages which is generally where the big money comes from. To collect statutory damages, you still need to send in a registration form into the copyright office as stated above.
What About Creative Commons?There is an alternative means by which you may copyright your work called Creative Commons ( http://www.creativecommons.org ). Basically what this does is create a copyright for your music whereby instead of all rights being reserved, only some rights are reserved. This invites others to use your work for certain purposes without having to get permission from you first. In theory, this means people searching for music to use in their products or digital creations are more likely to use your music if they don’t have to jump through a lot of legal hoops to make use of it. So, for example, you might allow a song to be used in a non-commercial product (ie. no financial profit for the distributor) without forcing the licensee to get permission from you, but still reserve the right to collect a royalty if the product in question is a money-maker. The Creative Commons copyright is still a rather new concept, and there are many variations on it that may make the concert confusing for the potential licensee. Even so, it is something to at least be aware of if the concept becomes more widely recognized and accepted. What About International Copyright?If you are not a citizen of the United States, obviously the comments above do not apply to you as every country handles the copyright process a bit differently. However, chances are that your homeland is a member of the World Intellection Property Organization (WIPO). If so, you can start researching your copyright options at http://www.wipo.int/members/en/ . Select your country name from the WIPO list, follow the “contact information” link, and that will take you to a page that lists the web site address of the copyright office for your country.

Tonight, during a questions and answers session with his twitter fans and followers, Randy Jackson answered several questions concerning Michael's death...well all that he could speak on... and stated that just because you don't hear anything more about it, it doesn't mean that he and the family aren't on it. Out of all the responses to the many questions he was asked, it was the one about Tina Turning shooting him back in the day that stuck with me most.

Now I know if I would have come up in here saying anything about sweet, innocent, Buddhist, ol' lady Turner SHOOTING him you wouldn't have believed me! So I took a screenshot of the tweet as proof. LOL Maybe you already knew about this, but I've heard NOTHING, so it was news to me!  Anyway here's the screenshot....

Rhinosilver Is Looking For 12 MUSIC TV SHOW HOSTS!! DEADLINE AUG 31st 2011


Okay, so by now you all should know or at least have an idea who Rhinosilver is and what they do. Especially since the last write up I did on them remains one of the top five most read entries on this blog.

Besides the fact that they're fastly becoming THE major distribution company who cater to distributing the product [cd's & dvd's] of artists who want to remain independent, they have also ventured off into TV Land. See one day you all will listen to me, I know potential when I see it. I told you all MONTHS ago about Rhinosilver I made a call out to Indy Artists so you all could jump on the bandwagon while they were still on ground level and NOW look at them!!! They're doing the George & Wheezy on us...."Movin On Up", and they are not playin'!

They just penned a deal with a major TV Station to produce Music TV Shows dealing with 6 different genres of music which I'll list later. The important thing is that they need hosts for these shows and that's where YOU come in.

So let me give you the rundown real quick. They'll have a total of 6 different shows showcasing, as I said before, 6 different genres of music and they need 2 hosts for each show. So in short, they're looking for 12 hosts in total, which means YOU have a really good shot of being one. Now of course nothing comes for free, and not that you have to pay any money, you DO have to spend some time on building in order to get the spot, and become a host on national TV.

Coming to us straight from Detroit, Lathun Grady has got to be one of the most slept on artists during the last decade. Although this young man was signed to Motown, I would say he's definitely still an underground artist. I mean, yeah he was signed to Motown, and he got his shine, but there wasn't enough light for anybody to really see anything.

I remember the first time I heard him sing....It was the summer of 2001. I was on TV hosting The Funkshop, my music video show and my video provider, sent me a video called Fortunate and asked me to add it in my rotation. It was the title track off Lathun's then new album "Fortunate". I listened to the song with it's Soothing melody....it had a kind of Latin Caribbean feel to it, with a dash of Hip Hop sprinkles. The lyrics were quite poetic and made me think of a time when I was in love and felt "Fortunate" because of it. You know there's no feeling in the world like one of being in love! I have to admit, I really liked the song, and the video was real cute too.....cute and simple. Okay so I was impressed enough to pay attention to this guy, but when I found out that he also wrote and produced MOST of the songs on his album I was wholly impressed. After that I was hooked, and I just knew for sure that this brother was going places. I added his video to The Funkshop Rotation and even though the label gave me his new CD, I still went out and bought one just to support the artist. Here's his song Fortunate. You'll probably remember it when you hear it. Listen to it, then I'll come back and tell you more about Lathun, with his pretty eyed self....Wooo!

Kanye's "Monster" Video Is Here... [Video Inside]

I don't know if I can say it was worth the wait, but Kanye's official video for MONSTER has finally been released. Sticking to Kanye's dark and eerie forte the video makes Michael Jackson's "Thriller" look like a walk in the park. Like everything visual Kanye has given us, the video can certainly be considered a bit over the top and is not suitable for the viewing of young children, the weak at heart, pregnant women, or the elderly. It even comes equipped with it's own disclaimer that reads:  "The following content is in no way to be interpreted as misogynistic or negative towards any groups of people. It is an art piece and it shall be taken as such."

You know how Im always getting on you guys [unsigned artists] about not having the paperwork for your songs in order? No copyrights, no publishing, no clean edits, poor production....etc. Well, it is for opportunities such as this one I have in my hand right now, that pop up out of the blue and end up catching most of you unprepared....and then you wonder why you never get your big break! And really it's nobody's fault but your own, mainly because you haven't done the things YOU were supposed to do. Im doing my part in providing you with the information of opportunities, but you have to do your part by taking the information and actually doing something with it.

N-T-Way....This entry is not to brow beat you in any way...and Im not going to go into another one of my tangents.  But for the record, I only go there because I love people who are blessed with God given talents and I don't believe they should be wasted due to lack of knowledge. So if I seem hard on Artists sometimes it's only because I want them to do better. Tough love may be hard to take sometimes but it is INTENDED to make a person do better.

Lastnight (5/15/11) One of the members of Cali Swag District went on to meet the creator. 22 year old Montae Talbert [better known as M-Bone]'s untimely death has not been determined as of yet, but hopefully we'll hear some word on the cause very soon. There are 4 members of the group total... 3 rappers and M-Bone who was the more quiet and laid back dancer. The group known for the song "Teach Me How To Dougie" morns the loss of their childhood friend, as shown here by a tweet that was discovered early this morning by the groups leader, Smoove: "Ma life changed drastically in the. Blink of an eye rip mbone."

Live Nation Entertainment, the concert and ticketing giant created by the merger of Ticketmaster and the promoter Live Nation, has emerged as a bidder for the Warner Music Group, according to a person apprised of the bidding who spoke only on the condition of anonymity because the process was intended to be confidential.

Live Nation’s chairman is Irving L. Azoff, whose long history in the music business includes a stint as chairman of MCA Records. He also controls Front Line Management, which manages the careers of more than 200 acts, including the Eagles and Christina Aguilera.

The verdict followed a four-day trial where Buju testified that he was entrapped by Alexander Johnson [a federal informant], and never wanted to purchase any drugs. Sounds like that testimony could have possible worked right??? Well unfortunately for him, that story got shot to hell and back when  a video that the prosecution presented to the jurors showed Buju actually tasting the shipment of cocaine inside of a warehouse. That pretty much sealed the deal for a conviction. I mean how could he explain THAT? Seems odd to be tasting the product if you're not buying it....Or maybe he was hungry.

This is 12 Year old Jawan Harris....well at least I heard he was only 12, but to be so young he's a pretty good singer although you can hear that he has a young sounding voice. I can't say that what he's doing on this track is really singing though. You'll see what Im saying when you listen to the song. Im really feeling the music on this track too. The song features Chris Brown which is a pretty nice touch to help carry the song. Raphael Saadiq - Good Man [Video]

Raphael Saadiq is back with his newest offering to us titled "Good Man". His upcoming album called Stone Rolling is scheduled for a March release. This video is a must see...very deep. You might have to watch it a couple times to see what's REALLY going on with the story line in this piece but it's well worth the watch. This video could definitely get people talking, especially after you see what the leading lady does in here to her all I can say is WOW......REALLY???

If you haven't already heard Mr.Clive Campbell better known to us as DJ Kool Herc is very ill and in need of an operation. He like many others of us in America is in need of medical insurance to cover his overloading medical bills. According to Herc's official website he's suffering from "kidney stones that caused him internal bleeding and serious pain."

Fact: If it wasn't for Kool Herc all of you who adore Hip Hop or have ever adored Hip Hop and it's culture, would have been  loving some other kind of music, because THIS is the man that started it all. You can't tell me you love Hip Hop and you don't know who this man is and what his contribution to Hip Hop was. IF you don't know you need to hit Google as soon as you finish reading here.
